Terms of Service

These terms cover your use of Orchard at tryorchard.us. Using Orchard means you agree to them. We kept the language plain on purpose: if something here is unclear, ask us at [email protected].

What Orchard is

Orchard is a marketplace of small AI tools. You give a tool some inputs, it runs, and you get a result. People can also build and publish their own tools. Orchard is in open beta: things will change, occasionally break, and sometimes disappear as we improve them.

How old you have to be

You must be at least 13 to use Orchard. If you are under 18, you need a parent or guardian's permission, and they are agreeing to these terms with you.

Some tools take a photo of a person. Two rules apply to every one of them: the photo has to be of you, or of someone who agreed to it, and it must not be a photo of a child. We remove what we find, and we close accounts that do it.

Some tools are meant for adults because of what they produce rather than what they take: the ones that reshape a body or rate someone's appearance. If you are under 18, those are not for you.

If we find out an account belongs to someone under 13, we close it and delete what we hold.

Your account

Sign-in is handled by Clerk. You are responsible for what happens under your account. You can use parts of Orchard without an account, with lower daily run limits.

Results are machine-made

Tool results are produced by AI models from the inputs you provide. They can be wrong, incomplete, or generic, and they can differ between runs. Results are not medical, legal, financial, or other professional advice, and they are not a substitute for a qualified person. Playful tools are entertainment. Use your judgment before acting on anything a tool tells you.

Your content

You own what you put in and what comes out. By running a tool you give us permission to process your inputs (including sending them to the AI providers that power the run) and to store your results so features like history and sharing work. Incognito runs are not stored. Only share links you are comfortable making public: anyone with a share link can see that result.

If you publish a tool, you are responsible for it. We can edit, unpublish, or remove any published tool at our discretion, especially ones that are harmful, deceptive, or broken.

Fair use

Daily run limits apply and are higher for signed-in users. Do not evade limits, scrape the service, probe or disrupt the infrastructure, use Orchard for anything illegal, or build tools designed to harm, deceive, or harass. We can suspend accounts that do.

What you may and may not put into a tool, and what you may publish, is spelled out in the Content Policy, which is part of these terms. To report something that breaks it, email [email protected].

Copyright and takedowns

If you believe something on Orchard infringes your copyright, send a notice to [email protected]. Include: what work was infringed, a link to the tool or result in question, your contact details, a statement that you believe in good faith the use is not authorized, a statement under penalty of perjury that the information is accurate and that you are the owner or authorized to act for them, and your signature (typing your name is fine).

We remove content that a valid notice identifies, and we tell whoever posted it. If you think your content was removed by mistake, reply to that message with a counter-notice and we will look again. Accounts that repeatedly infringe get terminated.

Deleting your data

Email [email protected] from your account email to delete your account or specific runs, and we will handle it. Self-serve deletion is coming. What we hold and how long we hold it is in the Privacy Policy.

No warranty, limited liability

Orchard is provided as-is, without warranties of any kind. It is a free beta service, and to the fullest extent the law allows, our total liability to you for any claim related to Orchard is limited to 100 US dollars. We are not liable for indirect or consequential damages, or for decisions made based on tool results.

Changes and contact

We may update these terms as Orchard grows. The effective date above always reflects the current version, and continued use after a change means you accept it. Questions: [email protected]. Our privacy practices live in the Privacy Policy.
